These terms govern your use of PDX Food Weeks (the "Service"), available at pdxfoodweeks.app. By accessing or using the Service you agree to them. If you do not agree, please do not use the Service.
1. Independent and unofficial
The Service is independent. It is not operated by, affiliated with, endorsed by, sponsored by, or otherwise associated with the Portland Mercury, EverOut, Negroni Week, or any other organizer, publisher or sponsor of any food or drink week described on it, nor with any restaurant, bar, brewery, roaster, café or cart listed on it.
All business names, logos, marks and menu descriptions remain the property of their respective owners and are used here for identification and commentary only. Menu information is compiled from organizers' publicly published listings and from the venues themselves. We do not originate it and cannot control what a venue actually serves.
2. Ratings and written notes are opinion
Scores and tasting notes published on the Service, including those recorded as passport stamps, are the personal opinions of the individuals who submitted them, based on their own experience of a particular dish, drink or visit on a particular occasion. They are subjective expressions of taste. They are not statements of fact, and they are not assertions regarding the quality, safety, cleanliness, licensing or business practices of any venue.
Chart positions are produced by applying a formula to those opinions. A chart position is not a review, a certification, an award, or an endorsement. No venue pays, and no venue has been offered any opportunity to pay, to appear on the Service, to achieve or improve a position, or to be removed.
A venue that believes material on the Service is inaccurate or objectionable may contact us at the address in section 11. We respond to such requests.
3. No assurance of accuracy
Hours, prices, addresses, availability, ingredients and dietary designations change frequently and often without notice, including during an event. Information on the Service may be incomplete, out of date or incorrect at any time.
You should confirm any detail that matters to you directly with the venue before relying on it. This applies with particular force to allergen and dietary information. We do not warrant the accuracy of any listing and accept no responsibility for any loss, wasted journey, or adverse reaction arising from reliance on it.
4. Alcohol
Some of the food and drink weeks described on the Service, and passports such as the Brewery Passport, concern alcoholic drinks. The Service does not sell, serve, supply or deliver alcohol, and takes no part in any sale of it.
In Oregon, alcohol may lawfully be purchased and consumed only by persons aged 21 or over. The parts of the Service that concern alcoholic drinks are intended for persons of that age. Each venue sets and enforces its own rules on admission, identification and service, and nothing on the Service affects them.
Nothing on the Service, including any passport, stamp, progress count or milestone, is an encouragement to drink, to drink more than you otherwise would, or to drink within any period of time. A passport is meant to be completed at your own pace. You are responsible for your own consumption and for arranging safe travel, and you should never drive after drinking.
5. Content you submit
You retain ownership of the tasting notes and other material you submit ("Your Content"). By submitting Your Content you grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce and display it in connection with operating the Service, including, where you have enabled the relevant profile setting, displaying it publicly alongside your display name. The privacy policy describes where public content appears.
You are responsible for Your Content and confirm that it is your own and that you are entitled to submit it. You must not submit material that:
- is abusive, harassing, threatening, or contains slurs or hate speech;
- asserts as fact any claim about a business that you are not prepared to stand behind;
- discloses another person's private information;
- is advertising, promotional, or submitted in exchange for any consideration; or
- infringes the rights of any third party.
We may remove any content, and suspend or restrict any account, at our discretion and without prior notice, including where we consider that submissions do not reflect genuine first-hand experience or that account activity is intended to influence chart positions. Restricting an account preserves the account holder's own records while withdrawing their contributions from public display.
6. Permitted use of the Service and its content
You may read, browse, quote, screenshot, cite and link to the Service freely and without seeking permission. Ordinary personal use is what the Service is for.
You may not, without our prior written consent:
- use any automated means, including any robot, spider, scraper, crawler, script or comparable process, to access, monitor or copy any part of the Service or its content;
- extract, compile, reproduce or store any substantial part of the content of the Service, whether by automated means, systematic manual copying, or otherwise;
- access any programmatic interface of the Service other than through ordinary use of the Service in a web browser; or
- republish, redistribute or make available any substantial part of the content of the Service, whether or not adapted, and whether or not for commercial purpose.
For the avoidance of doubt, we claim no proprietary right in the underlying facts of any event, venue or menu, which belong to the organizers and venues concerned. This section concerns the compilation: the aggregated, corrected, structured and enriched body of information made available through the Service, together with the ratings and written notes submitted by its users.
We may restrict or block access, including by technical means and without notice, where we consider that use of the Service does not comply with this section.
7. Accounts
You may hold one account. You are responsible for activity occurring under it. You may delete your account at any time from Profile, then Delete account. Deletion is immediate and irreversible.
The Service is provided free of charge. We may modify, suspend or discontinue it, in whole or in part, at any time and without notice or liability.
8. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any information on it is accurate or current.
9. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or business opportunity, arising out of or in connection with your use of or inability to use the Service, whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we have been advised of the possibility of such damages.
Nothing in these terms limits any liability that cannot be limited under applicable law.
10. General
These terms are governed by the laws of the State of Oregon, without regard to its conflict of law provisions, and the state and federal courts located in Multnomah County, Oregon shall have exclusive jurisdiction over any dispute arising from them.
We may revise these terms from time to time. The date at the top of this page indicates when they were last revised, and continued use of the Service after a revision constitutes acceptance of it. If any provision is found unenforceable, the remaining provisions continue in effect.
11. Contact
Corrections to a listing, requests from a venue, notices regarding content, and questions about these terms may be sent to hello@pdxfoodweeks.app.
